1.  How to Enter: NO PURCHASE OR LISTING NECESSARY.  The Contest begins December 15 , 2006 and ends at February 2, 2007 at 11:59 p.m. (Eastern Time).  You may enter the contest in either of two ways (1) fill in the online entry form at www.ForSaleByDave.com or www.Whitestone-Homes.com or www.LittleNeck-Homes.com.  Submit the entry according to the on-screen instructions (limit one (1) online entry per person per day).  Or (2) hand print your Name, Complete Address, Phone Number, and Email Address (optional) on either a postcard or a sheet of paper no larger than 8 1/2  x 11 inches and mail the postcard or paper to "Opening Day Contest", C/O Coldwell Banker Residential Brokerage, 61-43 186 Street, Fresh Meadows, NY 11365.  Entranties must be postmarked by February 2, 2007 and received by February 3, 2007.  

2.  Eligibilty: To enter the contest you must be a legal resident of the fifty United States and be 18 years of age or older.  The contest is void where restricted by law.  The Contest, and any website pages and advertisements relating thereto, is intended for veiwing only within the United States.  Employees of Coldwell Bnker Corporation, Cendant Corporation, Cendant Finance Holding Corporation, Coldwell Banker Real Estate Corporation, and their affiliated companies, parents, subsidaries, website developers and administrators, and advertising and promotion agencies, (collectively, "Contest Entities") and their immediate families and members of their household, are not eligible to participate in this Contest.

3.  Drawing and Notification:  The winner will be selected from all eligible entries received in a random drawing held on or about February 3, 2007 at approximately 3:00 p.m. by an independent judge whose decisions are final and binding in all respects.  Odds of winning a prize depend on the number of eligible entries received. Potential winner will be notified by telephone, email and/or U.S. mail.  If a potential winner can no be contacted within 24 hours, then such person shall be disqualified and an alternate winner will be selected.

4.  Prizes: One (1) Grand Prize Winner. One (1) Grand Prize of $100 1-800 Flowers Gift Certificate.  Sponsor reserves the right to substitute a prize of equal or greater value if a prize cannot be awarded as described for any reason.  All Federal, State, and Local taxes, if any, are the sole resonsibility of the individual winner.

5. Prize Conditions: Except where prohibited by law, the Grand Prize winner's entry and acceptance of the prize constitute permission for the Contest Entities to use said winner's Likeness (Picture), First Name (not Last Name) and town of residence to be place on the "Previous Winners" page of David Callaghan's Real Estate Websites in perpetuity, without further compesation.

6. Limitations of Liability:  Winner and entrants also agree to release, discharge, indenmmnify and hold harmless the Contest Entities, and each of their representative officers, directors, employees, representaives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest.  Contest Entities are not responsible for lost, late, misdirected, undeliverable, misplaced or incomplete on-line entries due to system errors, failures or any technical malfunctions which may limit an entrant's ability to particpate.   Contest Entities are not responsible for lost, late, misdirected, undeliverable, misplaced or incomplete U.S. Postal deliveries due to system errors, failures or any technical malfunctions which may limit an entrant's ability to particpate.  If for any reason this Contest is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the admistration, security, fairness, integrity or proper conduct of the promotion, then the Sponsor reserves the right at its sole discretion to cancel, terminate, modify o suspend the Contest.
